Can You Legally Drink & Ride A Bike In Idaho?
One of the best things about living in Boise and the Treasure Valley is the ability to enjoy all four seasons. Each season brings about a different vibe, with different activities to keep us entertained and happy throughout the year.
One of the most popular activities for Idahoans in the spring and summer months is enjoying an ice-cold beverage under the beautiful Idaho sun.
Still, it's important to remember safety first, especially when it comes to planning a safe ride home.
"Don't Worry, Y'all. I Brought My Bike."
In theory, riding a bike to a spot to enjoy some drinks doesn't sound like the worst idea. You don't have to worry about calling an Uber or the surge pricing that shows no mercy on your wallet. Also, there's the benefit of getting a little exercise to offset the alcohol, right?
Well... not quite.
According to Idaho law and DUI lawyers here in Idaho, there's good news and bad news.
The good news is if for whatever reason an officer stops you on a bike and notices that you're legally intoxicated, you cannot get busted or ticketed for a DUI or any drunk-driving infractions because your bicycle isn't defined as a "motor vehicle."
The bad news is that depending on how your arrest goes down, you can possibly be charged with public intoxication, resulting in you having to spend time behind bars to sober up, according to Idaho legislation.
Drinking and biking might not be the best idea unless you do them separately!
