Any person subject to this code who fights or promotes, or is concerned in or connives at fighting a duel, or who, having knowledge of a challenge sent or about to be sent, fails to report the fact promptly to the proper authority, shall be punished as a court martial may direct.

The key component thing to take away from this is “fails to report the fact promptly to the proper authority.” This means you’ll need to notify an officer about your arrangement with the nuisance of your life so they can be present to presumably ensure nothing gets out of hand during your fight... you know, cause you really don't like this person.

Also, if your battle gets messy, keep in mind that any property damage or harm to bystanders is still illegal during the fight.

But, at the end of the day, all it takes is a a phone call and a 4-hour drive if you want to throw hands with your worst enemy.
